Quotacy.com Terms of Use

The life insurance search and quote tools and service (collectively the “Service”) and other content provided on quotacy.com (the “Site”) is provided by Quotacy, Inc. and its subsidiaries and affiliates (“Quotacy” or “we”) subject to these terms of use (the “Terms”). These Terms describe the rules for using the Site including all subsidiary webpages and access to any optimized version of the Site via a wireless device, and are legally binding between you, the person using this Site, and Quotacy. Terms such as “we,” “our” and “us” refer to Quotacy.

By accessing and using the Service or any portion of the Site, you agree to be bound by these Terms. We may update these Terms at any time, and such updated versions will be posted on the Site. By continuing to use this Site after the Terms are updated, you consent to any such updated version of these Terms.

Intended Audience; Quotacy Licensing Information; Product Availability

To be eligible to use the Service, you must be at least 18 years of age and reside in the United States.

Quotacy.com is licensed to provide services as Quotacy, Inc. in all states.

Availability of insurance policy products varies by state and Site content may include information about products that are not available in your state. Information about insurance companies represented by Quotacy and their respective products is intended for residents of states in which those insurance companies are licensed. Applications will not be sought or accepted on behalf of any insurance companies from residents of states in which such insurance company is not licensed.

All applications for insurance are subject to underwriting qualification by the specific insurance company to which the application is submitted. Accordingly Quotacy has no control over whether you ultimately qualify for insurance at the estimated rates and Quotacy makes no warranties or guarantees with respect to qualification. Furthermore, availability of premium rates and policy forms may be changed by each insurer without prior notice. Suicide, misstatement and misrepresentation and other restrictions may apply.

Compensation Disclosure

Quotacy is an insurance producer licensed by the State of New York. Insurance producers are authorized by their license to confer with insurance purchasers about the benefits, terms and conditions of insurance contracts; to offer advice concerning the substantive benefits of particular insurance contracts; to sell insurance; and to obtain insurance for purchasers. The role of the producer in any particular transaction typically involves one or more of these activities.

Compensation will be paid to the producer, based on the insurance contract the producer sells. Depending on the insurer(s) and insurance contract(s) the purchaser selects, compensation will be paid by the insurer(s) selling the insurance contract or by another third party. Such compensation may vary depending on a number of factors, including the insurance contract(s) and the insurer(s) the purchaser selects. In some cases, other factors such as the volume of business a producer provides to an insurer or the profitability of insurance contracts a producer provides to an insurer also may affect compensation.

The insurance purchaser may obtain information about compensation expected to be received by the producer based in whole or in part on the sale of insurance to the purchaser, and (if applicable) compensation expected to be received based in whole or in part on any alternative quotes presented to the purchaser by the producer, by requesting such information from the producer.

Use of Site Content

The content on the Site are intended to provide information about Quotacy, our services, insurance companies and insurance products that may be available to you. All content on the Site, including text, graphics, icons, logos, layouts and images and their selection and arrangement (collectively “Site Content”), is the exclusive property of Quotacy or, if applicable, our licensors, and is protected by U.S. and international copyright laws. Insurance company logos are exclusive property of the respective insurance companies and are used with permission. All rights not expressly granted are reserved.

Quotacy may, in its sole discretion, suspend or discontinue the Site, Service, or any Site Content at any time without notice. Quotacy gives you permission to access, download, display and print one copy of the Site Content for your personal use, provided that you do not modify any Site Content and that you retain all copyright and proprietary notices contained in the materials. You may not otherwise “mirror,” reproduce, modify, distribute, transmit, post, or use the Site Content in any other media without Quotacy’s prior written consent.

The Site and Service are intended to provide general information about Quotacy and its services and represented insurance providers and their products that may be available to you. The Site and Service are not intended to constitute consulting, financial, accounting or other professional advice or services. While we strive to maintain Site Content that is accurate and up-to-date and provide quotes that are realistic, the Site Content, including quote information, is based on information provided by numerous providers that is subject to change and may include inaccuracies or material that is outdated. Quotacy does not represent the accuracy or reliability of any statement or information made available on or through the Site. Indemnification and Limitation of Liability

You agree to defend, indemnify, Quotacy and its subsidiaries, affiliates, officers, directors, employees, and agents as well as any third party providers of Site Content (“Site-Related Parties”), harmless from any claim, demand, or damage, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms or your use or misuse of the Site Content or Site.

YOU AGREE THAT NONE OF THE SITE-RELATED PARTIES SHALL BE LIABLE FOR ANY DAMAGE RESULTING FROM YOUR USE OR INABILITY TO USE THE SITE OR SITE CONTENT. THIS PROTECTION COVERS CLAIMS BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, AND ANY OTHER LEGAL THEORY. Governing law, Jurisdiction; Disputes.

These Terms are governed by the laws of the State of Minnesota without reference to the principles of conflicts of laws thereof. You agree that the only proper jurisdiction and venue for any dispute with Quotacy relating to your use of this Site, is in the state and federal courts in the State of Minnesota, U.S.A. You further agree and consent to the exercise of personal jurisdiction in these courts in connection with any dispute involving Quotacy or its employees, officers, directors, agents and providers. If any provision of these Terms is determined to be invalid under any applicable statute or rule of law, such provision is to that extent to be deemed omitted, and the balance of the Terms shall remain enforceable. Before seeking legal recourse for any harm you believe you have suffered arising from or related to your use of this Site, you agree to inform us in writing and to give us 30 days to cure the harm before initiating any action. You must initiate any cause of action within one year after the claim has arisen, or you will be barred from pursuing any cause of action.
